Dubois and King were the original engineers who did the original design, permitting and construction supervision. The dam was not included in the forest service's purchase of Blueberry Lake; as a result, ANR and the engineers have worked with the town on dam maintenance.

According to Town Administrator Cindi Hartshorn-Jones, the town is making the rocky side of the dam easier to maintain.

WARNED AND PERMITTED?

Warren resident and builder of the dam Lenord Robinson recently questioned whether the project was properly warned and permitted, as he said the ditch fill being used will contaminate the nearby stream.

"The material they are putting on the dam comes from cleaning the ditches and is heavily laden with salt which is going to run down through that blasted rock into the stream," Robinson said.

Jones said that the application, engineer design and permitting were all filed over two weeks ago and the town is in compliance. 

"The town was up in the area removing ditch fill from a ditch which will be spread out on top of the big rocks, smoothed out and finally seeded. All precautions have been taken as there is silt fencing at the base of the dam so that no material goes into the outlet stream," Jones said.

SINCE LAST FALL

Jones said the project has been in the works since last fall and that she is present at the inspection each year. She said that the project took the form of an administrative amendment and is standard maintenance.

Robinson said he contacted the town administrator who told him that the project was permitted.

"I said then that I did not see how they could get a permit to do that, but she said they had one. It is quite obvious that they did not have a permit and have since applied for one," Robinson said.

Jones said, "The town is not being fined; we are in compliance. The town is hoping that all the maintenance work should be completed by the end of November."
